Terms of Use

Article 1 — Purpose and publisher

These Terms govern access to and use of the Carvoh automotive marketplace (the "Site").

Carvoh provides a platform connecting vehicle sellers and buyers. Unless otherwise agreed in writing, Carvoh is not a party to the sale contract between users.

Article 2 — Acceptance

Accessing the Site or creating an account constitutes acceptance of these Terms and the Privacy Policy.

If you do not accept these conditions, do not use the Site.

Carvoh may amend the Terms; the applicable version is the one published at the time of use.

Article 3 — Eligibility and account

The Site is for adults with legal capacity, or their legal representative where required by law.

You must provide accurate information and keep it up to date. An account is personal; you are responsible for keeping your credentials confidential.

Carvoh may suspend or close an account in case of inaccurate information, abuse, fraud, breach of these Terms, or for security reasons.

Article 4 — Professional accounts

PRO features may require professional details (manager identity, VAT, address, phone, etc.) and manual validation by Carvoh.

Until the PRO account or organization is approved, some actions (publishing, stock, creating / joining an organization) may be limited.

Validation may be refused; any further review is at Carvoh's discretion.

Article 5 — Listings

The seller alone is responsible for listing content (accuracy, legality, rights in photos and text, vehicle and document compliance).

Prohibited content includes unlawful, misleading, counterfeit or discriminatory material, or content infringing third-party rights.

Carvoh may moderate, refuse, suspend or remove a listing, without prior notice where there is a legal or security risk.

Article 6 — Messaging, offers and transactions

Messaging and offers facilitate negotiation between users. They are not a guarantee of sale or a commitment by Carvoh.

Sale terms (price, payment, delivery, warranty, transfer of ownership) are agreed between buyer and seller, subject to applicable law.

You must not use messaging for spam, harassment, fraud or to circumvent Site rules.

Article 7 — Acceptable use

• Do not impersonate others or publish third-party data without authority.
• Do not circumvent security, verification or access controls.
• Do not use unauthorized bots or scripts to scrape or overload the Site.
• Do not harm the Site, Carvoh or other users.

Article 8 — Intellectual property

The Site, the Carvoh brand, logos, interfaces and databases remain the property of Carvoh or its licensors.

Content you publish remains yours; you grant Carvoh a non-exclusive, worldwide, royalty-free licence to host, display and distribute it on the Site to provide the service.

Article 9 — Personal data

Data processing is described in the Privacy Policy and Cookie Policy.

Article 10 — Availability

Carvoh endeavours to keep the Site available but does not guarantee uninterrupted or error-free service.

The Site may be modified, suspended or interrupted for maintenance, security or service evolution.

Article 11 — Liability

Carvoh acts as a technical intermediary. It is not liable for listings, vehicles, or failures between users, within the limits of applicable law.

Carvoh's obligations are best-efforts obligations.

To the extent permitted by mandatory law, Carvoh's liability is limited to direct, proven damage.

Nothing in these Terms excludes liability that cannot be excluded under consumer law.

Article 12 — Force majeure

Carvoh is not liable for delays or failures caused by events beyond its reasonable control (network outage, cyberattack, third-party failure, disaster, etc.).

Article 13 — Severability

If any clause is invalid, the remaining clauses stay in force.

Article 14 — Governing law and disputes

Belgian law.

Disputes: courts of the judicial district of Charleroi, without prejudice to mandatory rules giving jurisdiction to the consumer's domicile.
